Kopy-Rite guarantees that the
materials and /or products provided to its customers
will be free from defects in workmanship. In the unlikely
event that a defective product is received, Kopy-Rite
agrees to replace the product returned to our facility
at no charge to the customer. Or, Kopy-Rite may, at
its option, choose to refund any monies paid to Kopy-Rite
for defective products returned to our facility.
A product shall be considered
defective if it does not compare to the audit copy
created by Kopy-Rite and approved by the customer.
The comparison will be conducted on both production
equipment and standard PC's at Kopy-Rite in Troy,
Michigan.
The customer should specifically
note that there will be some isolated cases in which
a duplicated product cannot be read on certain drives
even though it does not contain any defects. Kopy-Rite
cannot guarantee that every drive manufacturer conforms
to all industry standard specifications. This "interchange"
problem is not widespread, but it does exist. This
type of problem would generate a situation in which
an end user is unable to read a product, but that
same product can generally be read on other systems.
Kopy-Rite will absorb the cost
of returning any defective product to its Troy, Michigan
facility. Kopy-Rite will not assume any responsibility
for transporting the product from its end user's site
to Kopy-Rite, unless the customer is also the end
user. Furthermore, Kopy-Rite will not be responsible
for any costs associated with removing the product
from customer materials, the cost of materials themselves,
or the cost of repackaging the product. Kopy-Rite
will not be responsible for any consequential damages
that may result from any defective product, except
for the cost of replacing the defective product. The
customer is free to test any product prior to packaging
and/or distribution.
Kopy-Rite will endeavor to replace
any defective materials promptly and professionally.
The amount of time required to replace the product
will vary depending on the product and the quantity.
If Kopy-Rite is unable to correct the defect, or cannot
do so in a reasonable timeframe, then Kopy-Rite may
choose to refund or credit the customer's account
some or all of the amount charged. Under no circumstances
will Kopy-Rite be liable for any amount greater than
the amount originally billed to the customer.
